In 2021, the Italian Constitutional Court issued an important decision (n.° 37/2021) which put an end to the derogation of national health care policy by the Italian Regions. Previously, an apparent discrepancy had in fact emerged in the relations between center and periphery with respect to the provisions of the Italian Constitution. Therefore, in this paper I will try to explain the main reasons why this phenomenon could arise and what the outcome was. In order to do this, I will briefly review some aspects of the Italian constitutional history from 1948 to the present day by comparing theory (that is, the provisions of the Constitution and their ideological foundation) and practice.
