Twice challenged, Apulia Law 28/2022 deals with environmental compensations. The case is of interest because of the implicit recognition of broad Regional autonomy in the provision of measures to foster solidarity through energy matters. At the same time, while awaiting the Constitutional Court’s pronouncement, the rule extending its applicability to infrastructures already in place suggests the existence of a systemic limit beyond which regional regulation cannot advance, such that environmental and social goals must be balanced with other equally important interests.
